The conference constitutes a part of the research Project False friends in comparative law Threats and advantages of legal transplants in private law - the Polish-German perspective (2021-06) supported by the Polish German Foundation for Science (DPWS/PNFN) and performed by Kozminski University Chair of Civil Law & Osnabrück University European Legal Studies Institute.

The conference will be hosted by the Kozminski University in Warsaw, on November 27, 2024.

About Conference

An impulse for the conference became interferences between the Polish and German law. The German law served as a vital inspiration for Polish legislators in the 20th century and its influence on the Polish doctrine, jurisprudence and legal practice still exists and develops. Results of this influence are twofold. On the one hand, there are noticeable examples of successful receptions of German legal concepts and theories into the Polish private law. On the other hand, an instrumental and selective use of German law, combined with a lack of an in-depth dogmatic and axiological analysis results in an adoption of German-law-inspired concepts in an extra-systemic way, detached from its roots, fundamental principles or values underlying it. Borrowings from concepts or institutions for which German law was an inspiration, but which were transposed into Polish law without considering deep systemic considerations and result in distortions of the essence of the transposed institution, are examples of false transplants, named False Friends.

The overarching objective of the conference is to identify, examine and describe both - the real and the false transplants from German to Polish private law.  

Conference topic

We encourage presenters to focus on the constructions of private law and their dogmatic assumptions, identify the real or false borrowings between Polish and German law, and to discuss them in the context of legal doctrine, jurisprudence or practice.   Presentations may refer to Polish law concepts, theories or solutions modelled on German law, or institutions of Polish law which are not directly modelled on German law, but only normatively or functionally similar to solutions present in German law, pretending to be legal transplants.

The areas of analysis may involve broadly understood private law, including i.e. civil law, copyright law, arbitration law or even some aspects of law of new technologies.

Abstracts

We kindly invite participants to submit an abstract for a conference paper (max. 400 words) they would like to present during the conference. Abstracts shall be submitted by 20 October 2024, 11 p.m. (CET).

Publication

Conference organizers can offer a publication opportunity for selected papers. Papers corresponding with the project profile, following the positive reviews, may be included into the monograph published in a recognised publishing house specialised in law.

Conference Language: The main language of the conference is English. The conference papers may be presented in either English or Polish.

Payment: Conference participation is free from charges (number of stationary places is limited).

The conference is available in a hybrid format. Presenters are welcome to attend in person. Participation without papers is possible in both modes, in-person or online.
