False friends in comparative law Threats and advantages of legal transplants in private law - the Polish-German perspective
The German law served as a vital inspiration for Polish legislators in the 20th century and its influence on the Polish doctrine, jurisprudence and legal practice still exists and develops. Results of this influence are twofold. On the one hand, there are noticeable examples of successful receptions of German legal concepts and theories into the Polish private law. On the other hand, an instrumental and selective use of German law, combined with a lack of an in-depth dogmatic and axiological analysis results in an adoption of German-law-inspired concepts in an extra-systemic way, detached from its roots, fundamental principles or values underlying it. Borrowings from concepts or institutions for which German law was an inspiration, but which were transposed into Polish law without considering deep systemic considerations and result in distortions of the essence of the transposed institution, are examples of false transplants, named False Friends.
The overarching objective of the conference is to identify, examine and describe both - the real and the false transplants from German to Polish private law.
The conference is free and hybrid.
