Dr. Dawid Kostecki from Kozminski University receives funding for research on the optimal model of lawmaking

The research focuses on the quality of the lawmaking process in Poland, which – despite formally meeting the constitutional standards of a democratic state – often faces procedural barriers and quality deficits in practice. Dr. Kostecki will conduct a comparative analysis of legislative mechanisms in Poland and Switzerland, where a mature culture of direct democracy and the use of referendums provide an inspiring reference point for exploring more effective models of legislation. 

The project addresses long-standing challenges in the Polish legislative process, including legal inflation, insufficient public consultations, instrumental use of parliamentary procedures, and the lack of comprehensive regulatory impact assessments. The study visit in Zurich will allow for consultations with leading European legal theorists and the development of comparative research on functional models of legislation in different political systems. 

“Switzerland offers a unique example of a state where mechanisms of direct democracy coexist with strong institutional stability. Analysing this model may help us understand how to enhance the Polish lawmaking process – not by replicating foreign solutions, but by identifying principles and practices that truly support legislative rationality,” emphasizes Dr. Dawid Kostecki, author of the project. 

Dr. Kostecki’s research reflects Kozminski University’s mission to support research projects with social and institutional relevance. The outcomes of the study will contribute to developing recommendations aimed at improving the quality and transparency of legislative processes in Poland.
